Court upholds Warner Robins woman's murder conviction

According to her appeal, Ebony Smith wanted to be tried by a judge rather than a jury. But prosecutors refused.

Georgia's Supreme Court has upheld the conviction of a Warner Robins woman convicted of killing her husband three years ago.

In 2011, police said Ebony Passion Smith shot Brian Smith to death in their Jay Road home. Then she tried to kill herself with medication.

According to her appeal, Ebony Smith wanted to be tried by a judge rather than a jury. But prosecutors refused.

On Tuesday, citing previous decisions, the state's court unanimously said that the Houston district attorney had the right to demand a jury trial.

Last year, Ebony Smith was convicted of eight charges, including murder. She was sentenced to life with the possibility of parole.
