'That'll be a decision that the state will make': Warner Robins man could face death penalty in Florida shooting

According to investigators, first-degree premeditated murder is a capital felony in Florida.

MIRAMAR, Fla. — The charges a Warner Robins man faces in Florida could result in the death penalty if he's found guilty. 

In September 2023, Gunnar Cole is accused of going on a shooting spree in Florida. Now, a Walton County grand jury indicted him on new charges tied to the case. 

"Everybody is shocked about just as we are about what happened," said Captain Dustin Cosson with the Walton County Sheriff's Office

Cosson says they spoke with Cole's family about the incident when it happened but, after speaking with Cole, they're not sure if the Warner Robins man will explain himself. 

"We still don't have the answer of why, and we may never have that answer of why," Cosson said. 

In September, Walton County deputies received several calls about an active shooter in the Sandestin resort area. During the shooting rampage, Cole is accused of shooting one man in a burning car and shooting at several cars driving by. They also accuse Cole of shooting at deputies, too. 

The grand jury indicted Cole for one count of first-degree premeditated murder, five counts of attempted first-degree premeditated murder and six counts of shooting into an occupied vehicle.

Cosson says each count against Cole has to be proven in a court of law.

"Reviewing multiple different angles of the video camera, hours of video camera footage, things like that to show and also the statements and information the victims provided," Cosson said. 

Cosson told 13WMAZ that three different investigations were going on at the same time for this one situation. 

"All those combined again was not a it was a unique challenge but I think the grand jury indictment that it was done exceptionally well," Cosson said. 

If found guilty, the charges Cole faces could comes with serious consequences under Florida law. 

"A first-degree premeditated murder charge is a capital felony in Florida so it's punishable up to death. That'll be a decision that the state will make when it comes time for prosecution," Cosson said."

Cole's arraignment date is not set and he has been held in the Walton County Jail.
