The man accused of killing two Peach County deputies was in court Monday for what was supposed to be his arraignment hearing.
Elrod is accused of killing Peach County Sgt. Patrick Sondron and Deputy Daryl Smallwood on Nov. 6, 2016.
The arraignment has been pushed back to July 6. Elrod's attorney, Frank Hogue, told the judge he needed more time to consult with his client.
"We just haven't had a chance to talk about it with him because it wasn't on the court's order today for what we were going to do. So, I didn't bring it up. I would rather have time to tell him what's involved in a formal arraignment," explained Hogue.
Though the arraignment was delayed, Hogue did address several other motions like a request for Elrod to wear civilian clothes and no shackles during court appearances.
"He should likewise be afforded the opportunity to wear street clothing," announced Judge Edgar Ennis as he approved the motion.
Hogue says that jail attire could bias potential jurors watching local media.
"They may have watched your news show or other news programs and have seen him in an orange jail jumpsuit and chained like he's dangerous and needs to be shackled. That will form in an impression in potential jurors minds that he's a very dangerous guy," says Hogue.
They also addressed Elrod not having to answer whether he was satisfied with his defense. Despite the arraignment delay, District Attorney David Cooke says they're ready for anything.
"The defense asked for a continuance saying that they were not ready. Of course, we're ready. We're ready to get justice for deputies Sondron and Smallwood and their families and the community and we look forward to the day that we can get justice in the courtroom," says Cooke.
