DEKALB COUNTY, Ga. (WXIA) -- Hemy Neuman's lawyers will be back in court on Tuesday to make a motion for a new trial.

Neuman's attorneys list 23 reasons he should get a new trial, including the fact that Andrea Sneiderman was found guilty of perjury.

The judge will hear arguments on the motion Tuesday at 1:30 p.m. in DeKalb County court.

In March 2012, a jury found Neuman guilty but insane in the death of Rusty Sneiderman outside a Dunwoody daycare. Hemy Neuman was sentenced to life without parole and has since lived in a medical prison in Augusta.

Prosecutors claimed Neuman was having an affair with Rusty's wife Andrea.

Andrea Sneiderman was found guilty of perjury in August 2013 after murder charges were dropped before her trial.
