MACON, Ga. — A former Bibb County Sheriff’s Deputy was fired in October for making false statements to a grand jury that led to the indictment of a former co-worker, according to a termination letter.

Nicholas Denny was fired on Oct. 15 after an internal affairs investigation into the case against Kendrell Daniely.

He's a former Bibb jailer who was accused of giving a gun to his brother, a suspected Crips gang member.

Sheriff David Davis’s termination letter says that Denny’s statements to the grand jury did not match his recorded interview with Daniely.

“These discrepancies illustrate either a willful or negligent misstatement of facts.” the letter reads.

Macon District Attorney Anita Howard dropped the charge against Daniely.

Davis's letter quoted Howard as saying: “Because of the gravity of this situation, our office can no longer rely on information provided by Denny and cannot prosecute any cases that rely solely on his testimony.”

Susan Ryan, a consultant with the District Attorney's Office, said Howard reported the false statements to the Bibb County Sheriff's Office and POST, the state agency that certifies law officers. Ryan says the investigation into Denny is still active.

Documents show that Howard dismissed the case in October 2023 because of her findings. A year later, Davis terminated Denny.

The termination letter says Denny's false statements “makes it problematic for you to engage in any law enforcement function.” Davis found Denny to be in violation of multiple policies including abuse of power and unbecoming conduct.

Davis also says Denny chose to arrest Daniely in the middle of a Georgia Public Safety Training Center Basic Mandate Class.

“The fact that you put forth the effort to arrange for Mr. Daniely’s arrest at a location that would cause embarrassment and cause disruption to a law enforcement training class demonstrates a degree of malice not appropriate to law enforcement," the letter said.

Kendrell Daniely filed a federal lawsuit against Denny for damages related to this case.

Another man, Roddrick Jordan, sued Denny after he allegedly instructed deputies to conduct a warrantless search of his home on Aug. 16, 2023, and when he did secure a warrant to conceal the illegal search, Jordan's attorney claimed Denny lied on it too.

Christy Curreli, who is representing Denny in the federal lawsuits, says that they declined to comment.
